Introduction

Our standard Terms and Conditions are set out below and form part of any confirmed booking made with Reportage Photography. The purpose of these Terms and Conditions is to provide both you as the client and us as the service provider, with a clear understanding of the agreement we make. Please read and agree to our terms and conditions in full, before confirming any booking with Reportage Photography. If you would like to discuss or clarify any points, please do not hesitate to contact us.

These terms and conditions explain your rights and responsibilities and also ours.

“You” means the Client named on the ‘Booking Form’
“We” means Reportage Photography.
“Contract” means the ‘Booking Form’ signed by you and incorporates these terms and conditions.
“Wedding” shall, if the context so requires, be deemed to be a reference to a civil partnership ceremony or any other analogous ceremony.

 

Terms & Conditions

  1. Confirmation of a booking will only be made on receipt of a completed Booking Form and a non refundable deposit of £300. Upon receipt of the booking form and deposit, we will reserve the date agreed upon and will not make any other bookings for that date. For this reason all deposits and final payments are non-refundable, even if the date is changed or the wedding cancelled for any reason.
  2. All payments must be made by cheque or direct bank transfer. Please do not send cash in the post.
  3. On confirmation of a booking, we will have the exclusive photographic rights for the wedding in question and will act as the official photographer at your wedding. Amateur photography by guests will be permitted but you must ensure that this does not interfere or conflict with the services we have agreed to provide.
  4. We agree to supply to you, wedding photography services in accordance with the Contract. The Contract incorporates all the terms agreed between us and no variation shall apply unless agreed in writing and signed by both parties.
  5. We ask you to note any special requests in the space allocated on the Contract provided for that purpose. We will endeavour to accommodate any reasonable requests made by you and will let you know if this is not possible.
  6. The Booking fee is payable by you on the signing of the Contract. This will be set against the total fees agreed and payable by you.
  7. Once a booking is made we will ensure that we visit the place where you are getting married and your reception venue at least once before your wedding day. At this meeting we will discuss the timings of the day as well as the most appropriate place to take the formal and family pictures.
  8. The balance of the Package Fee must be paid by you no less than 28 days prior to the date of your wedding and no earlier than 56 days in advance. A balance invoice reminder will be issued one month before the date of your wedding. If the balance fee is not paid by the due date, we reserve the right not to provide any services until payment is made or treat the contract as cancelled.
  9. If we do not receive the balance payment for a booking made, we reserve the right to take appropriate action to recover up to 75% of the package fee as agreed in the Contract.
  10. You may cancel the Contract at any time by notice in writing. You will then be liable to pay to us compensation based on a percentage of the agreed Package Fee depending upon when the notice is received: 120 days of more = Booking Fee only, 120 to 90 days notice = 50% of the Package Fee, 89 to 60 days notice = 60% of the Package Fee, 59 to 30 days notice =75% of Package Fee, 30 to 0 days = 100% of the Package Fee.
  11. All prices include VAT where applicable and are fully inclusive including travel, unless otherwise stated.
  12. We strongly recommend that you take out a full and appropriate wedding insurance policy, to safe guard against any unforeseen eventuality.
  13. The Package Fee includes the time and expense of our photographer/s traveling to and from the agreed locations. It also includes his time to take photographs as stated in the Contract. If the photographer is requested to stay for a longer period at the wedding or reception we will endeavour to accommodate all reasonable requests, however we cannot guarantee that we will be able to do so. We reserve the right to charge an additional fee for all additional coverage. Additional hourly rates are charged at £150 per hour, as specified in our current price list.
  14. A separate fee will be charged for all additional services ordered such as additional prints, framed photographs etc. Additional retouching of digital files, digital manipulations and artist finishing may be available on request. The price of any additional services must be paid in full on order.
  15. In the highly unlikely event that Reportage Photography is unable to attend for reasons beyond our control (e.g. death, injury or severe illness) we will use our best endeavours to arrange a suitable replacement. Any replacement will be agreed and approved with you in advance of your wedding. If you are unhappy with the alternative replacement a full refund will be provided. This will be the full extent of our responsibility to you in these circumstances under this agreement. We will not be liable for any other costs incurred whatsoever.
  16. We will discuss with you your general requirements and wishes in relation to the taking of the photographs. You should be aware that it may not be possible for all these to be followed due to factors such as weather conditions, lighting conditions, the subjects being photographed and changes in time constraints. You, therefore, grant us full and unfettered artistic licence in relation to the content of the photographs, their arrangement, composition, location and the number of photographs taken.
  17. Photographs will be taken against the available backgrounds. Please note that we cannot move objects or perform other cosmetic duties on location.
  18. Weddings should be happy and relaxed occasions but the cooperation of you and your guests is essential in ensuring that the photography goes smoothly, the best results are obtained and your goals achieved. You are, therefore, responsible for ensuring punctuality and the co-operation of your guests.
  19. Every effort will be made to provide an identical colour balance between photographs but this may not always be possible due to factors such as lighting conditions and digital sensor limitations. Prints made on different occasions or in different sizes may also vary. Accordingly, no warranty is given that an exact colour match can be provided.
  20. We use only professional quality equipment and photographic suppliers and whilst you are assured of the very best attention at all times, it is understood that neither the photographer nor Reportage Photography can be held responsible for any faults on sensitised materials, chemicals, mechanical, electrical, digital or optical equipment.
  21. Prints and products must be ordered by you and your guests within 12 months of the wedding. After this time we cannot guarantee being able to fulfil order and any order which we do fulfil will be subject to our then current price list.
  22. The copyright of all the photographs on the day remain the property of Reportage Photography whether stored digitally or otherwise and any computer program including any source or object code, computer file or printed documentation relating to such images remains our copyright. Certain packages and options include a DVD of the images taken on the day. If your package includes a DVD or you take this extra option, you have the right to make unlimited reprints however the copyright retains with Reportage Photography. Any copying of photographs that we have supplied will be deemed in breach of the Copyright Act 1988 and is strictly illegal.
  23. We reserve the right to use or display any images created as part of this Contract as part of our portfolio, at exhibitions, for marketing / advertising purposes, competitions and all other appropriate purposes without prior notification to you.
  24. We reserve the right to have an assistant helping on the day of your wedding. The decision on whether or not to have an assistant will be based on a number of factors (length of coverage, number of guests, availability). All of the assistants who we employ are all polite, friendly, unobtrusive and smartly presented. They are all photographically competent and will act in a courteous manner when dealing with your guests.
  25. Please note that food and soft drinks will be required for any coverage over six hours for the photographer and his assistant if applicable. Whilst a full meal will not be required refreshments in the form of sandwiches and soft drinks would be appreciated.
  26. We will exercise the reasonable skill care and judgment that you would expect of a professional photographer but we shall not be liable for events beyond our reasonable control. Under no circumstances will our liability to you, whether for breach of contract, negligence, breach of statutory duty or otherwise exceed the total amount that you have paid to us under this Contract. Our fees have been calculated on this basis. If you wish to have additional cover we would recommend that you consider taking out a policy of insurance.
